Why under-resourced Legal & Compliance teams burn out and put businesses at risk
Legal & Compliance is too often treated as a cost centre. The thinking goes: keep the team lean, keep overheads down.
On paper, that might look efficient, but it usually backfires.
When “lean” means overloaded
Most Legal & Compliance teams I speak to already carry wide portfolios – contracts, policies, board support, risk advisory, regulatory updates. It’s a lot. Strip the team down further and you don’t magically get efficiency; you just load more onto fewer shoulders.
This inevitably leads to long hours, constant firefighting, and eventually burnout. And when someone resigns, the cycle gets even worse.
From strategic to reactive
A stretched team doesn’t have the breathing room to get ahead of risks or shape strategy. Instead of adding value at the table, they’re stuck reacting to issues as they come up. That only fuels the perception that Legal & Compliance is a bottleneck when the truth is, they’re simply under-resourced.
The hidden price tag
The “savings” on headcount are quickly wiped out when things slip:
- Regulatory fines (think POPIA, and soon COFI).
- Disputes from rushed or unchecked contracts.
- Reputational damage from governance failures.
One mistake can cost far more than an extra pair of hands on the team.
What works instead
The businesses that get this right don’t overinflate their teams, but they do size them realistically, give people the tools to succeed, and recognise Legal & Compliance as value creators, not overhead. That’s when professionals stay loyal, deliver strategically, and actually reduce risk.
At OutsideCapital, we help clients build Legal & Compliance teams that are lean without being overstretched – balancing cost control with long-term resilience.
If you’d like to talk about how other organisations are structuring their teams, or what the market benchmarks look like right now, I’d be happy to share what we’re seeing.
